Terms.
Sample wording for a template. Replace all of it with terms your own solicitor has read.
Who you are contracting with
Bellwether Software Ltd, registered in England and Wales. Registered office: Bellwether Software Ltd, 14 Ashdon Row, Bristol BS1 4TR. Company number 09184472. VAT registration GB 284 1109 43.
The service
Bellwether records which files each of your tests loads, and returns a selection on each subsequent commit. It is a decision aid inside your pipeline. It does not run your tests, it does not gate your merges, and the configuration that decides what to do with a selection remains yours.
Data
The recorder sends file paths, test identifiers, timings and results. It does not send source code, environment variables or the contents of any file. Records are retained for 400 days and exportable as JSON at any point. Deleting the account deletes them within 30 days.
Billing
$40 per developer, per month, billed yearly in advance. A developer is anyone who pushed a commit that Bellwether ran against during the billing month. Seat counts are recalculated monthly and any difference is settled at renewal rather than in arrears.
Ending it
Remove the pipeline step whenever you like. Notice is not required and the remaining term is not refunded, which is the trade for a yearly price. Nothing about your pipeline depends on us continuing to exist.
Liability
Nothing here limits liability for death, personal injury or fraud. Beyond that, liability is capped at the fees paid in the twelve months before the claim. We are not liable for a defect that reached production through a test that was correctly skipped according to a map you had the ability to inspect.
Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
